1. About Morfoto
Morfoto is a platform that enables photographers to sell digital and print photos from events. It is operated by Elera Yazılım ve Bilgi Teknolojileri Ltd. Şti., Istanbul, Turkey. By using morfoto.app, you agree to these Terms of Service.
2. Who can use Morfoto
Morfoto has two types of users: photographers (who create events and sell photos) and guests (who browse and purchase photos at events). You must be at least 18 years old to make a purchase or create an account.
3. Photographer accounts
- You are responsible for the accuracy of your account information.
- You must only upload photos you have the right to sell. You retain copyright in your photos.
- By uploading photos, you grant Morfoto a limited licence to display, store and deliver them to buyers on your behalf.
- You are responsible for obtaining any necessary consent from individuals photographed, in accordance with applicable law.
- Morfoto may suspend accounts that violate these terms or applicable law.
4. Purchases by guests
- Prices are set by the photographer and displayed on the event page.
- Payment is processed by iyzico Payment Services Inc. Morfoto does not store card details.
- After a successful payment, digital photos are delivered via a download link. Print products are fulfilled as described on the event page.
- All sales are final. Please review our Delivery and Returns policy before purchasing.
5. Biometric data and face recognition
Some events use face recognition to help guests find their photos. Participation is always voluntary and requires explicit consent. Biometric data derived from your selfie is used only for photo matching within that event and is deleted automatically after the event closes. See our Privacy Policy for details.
6. Prohibited conduct
You must not:
- Upload or distribute content that infringes third-party intellectual property rights.
- Upload photos of individuals without appropriate consent.
- Attempt to circumvent payment, access controls or security measures.
- Use the platform for any unlawful purpose or in a way that could harm other users.
7. Intellectual property
Photographers retain all copyright in their photos. Morfoto's platform, branding and software are the exclusive property of Elera Yazılım ve Bilgi Teknolojileri Ltd. Şti. and may not be copied, modified or distributed without written permission.
8. Limitation of liability
To the maximum extent permitted by applicable law, Morfoto is not liable for indirect, incidental or consequential damages arising from your use of the platform. Our total liability to you will not exceed the amount you paid for the relevant transaction.
9. Governing law
These terms are governed by the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of Istanbul courts, except where mandatory consumer protection law in your country of residence provides otherwise.
10. Changes to these terms
We may update these terms from time to time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
